Title IX of the Education Amendments of 1972 (“Title IX”), 20 U.S.C. § 1681(a) states: “No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance . . . .” 20 U.S.C. § 1681 et seq.

When a student suffers harassment, discrimination, and sexual misconduct based on their sex, gender, and gender identity, their rights under Title IX are being violated.

A 2020 Report found that 29 % of undergraduate students who identify as women reported experiencing “nonconsensual penetration, attempted penetration, sexual touching by force, or inability to consent” while enrolled at college or university. (Report on the AAU Campus Climate Survey on Sexual Assault and Misconduct).
